Welcome to StudioRack. These Terms & Conditions ("Terms") govern your use of the StudioRack platform at thestudiorack.com (the "Platform"), operated by StudioRack Ltd ("StudioRack", "we", "us"). By accessing or using the Platform, whether as a photographer booking a studio ("Photographer") or a studio owner listing a space ("Host"), you agree to these Terms. If you do not agree, you must not use the Platform.

1.Eligibility

You must be at least 18 years old and able to enter into legally binding contracts to use StudioRack. The Platform is currently available only to users and studios located in the United Kingdom. By using the Platform you confirm that you meet these requirements.

2.What StudioRack Is

StudioRack is an online marketplace that connects Photographers seeking studio space with Hosts who list their photography studios for hire. StudioRack is not a party to any rental agreement between a Photographer and a Host. We provide the technology that facilitates discovery, booking, and payment. The contract for the use of any studio is solely between the Photographer and the Host.

3.Accounts

You are responsible for keeping your login details secure and for all activity under your account.
You agree to provide accurate, current information and to keep it updated.
We may suspend or terminate accounts that breach these Terms or that we reasonably believe are being used fraudulently.

4.Bookings & Payments

When a Photographer books a studio, payment is taken in full at the time of booking via our payment processor, Stripe. Prices are displayed in GBP and include a StudioRack service fee.

Platform fee: StudioRack charges a 10% platform fee on each booking. The Host receives 90% of the total booking value.

By making a booking you authorise StudioRack to charge your chosen payment method for the full amount shown. A booking is only confirmed once payment has been successfully processed.

5.Cancellations & Refunds

Before a Host accepts: A Photographer's card is only authorised, not charged. If the booking request is declined or withdrawn before acceptance, no charge is taken and the authorisation is released.

After a Host accepts (booking confirmed):

Cancellations made more than 48 hours before the booking start time receive a full refund.
Cancellations made within 48 hours of the booking start time receive a 50% refund.
No-shows, or cancellations after the booking start time, are non-refundable.

To cancel a confirmed booking, contact StudioRack and we will arrange any refund due under the policy above. Refunds, where due, are processed back to the original payment method and may take 5–10 business days to appear. If a Host cancels a confirmed booking, the Photographer will receive a full refund regardless of timing, and StudioRack may take action against the Host's account for repeated cancellations.

6.Host Payouts

Payout terms: Hosts receive 90% of the total booking value. Payouts are made within 48 hours after the rental date, provided the booking was completed without dispute. StudioRack retains the 10% platform fee.

Hosts are responsible for providing accurate bank details for payouts and for declaring and paying any tax due on their earnings. StudioRack does not provide tax advice.

7.Host Responsibilities

Hosts must accurately describe their studio, including size, equipment, facilities, and any restrictions.
Hosts must ensure the studio is safe, legal to use as described, clean, and available at the booked time.
Hosts must hold any insurance, licences, or permissions legally required to operate their studio.
Hosts confirm they have the legal right to list and hire out the space.
Recommended: to protect both parties, we strongly recommend Hosts keep dated photos of the studio and equipment in their normal condition. This is not required, but it provides a clear baseline if a damage claim ever arises.

8.Photographer Responsibilities

Photographers must use the studio responsibly and only for lawful purposes.
Photographers are responsible for any damage they cause to a studio or its equipment during their booking. By booking, the Photographer authorises StudioRack to charge their payment method for the reasonable, documented cost of repairing or replacing any such damage, and to apply any refundable security deposit held for the booking towards that cost. StudioRack will request evidence of the damage (such as dated before-and-after photographs) before any such charge is made.
Recommended: before starting your shoot, we strongly recommend photographing the studio and its equipment to record their condition. This is not required, but it protects you from being held responsible for any pre-existing damage and gives both you and the Host a clear, dated record.
Photographers must report any pre-existing damage or issues to the Host promptly, and ideally before the booking begins.
Photographers must leave the studio in the condition they found it and vacate at the end of their booked time.

9.Studio Listings & Approval

All new studio listings are reviewed by StudioRack before going live. We reserve the right to reject, edit, or remove any listing that does not meet our standards, is inaccurate, or breaches these Terms, without liability to the Host.

10.Prohibited Conduct

You agree not to use the Platform to: post false or misleading information; circumvent StudioRack to avoid fees; harass other users; upload unlawful, infringing, or harmful content; or attempt to disrupt or gain unauthorised access to the Platform.

No off-platform bookings (anti-circumvention): Hosts and Photographers who are introduced to one another through StudioRack agree not to solicit, arrange, accept, or complete bookings for the same or substantially similar services outside the Platform in order to avoid StudioRack's fees, for a period of twelve (12) months from their first booking or contact made through StudioRack. This includes exchanging contact details in order to take repeat or future bookings off-platform. StudioRack may suspend or terminate the account of any Host or Photographer who breaches this clause, and may charge the fees that would otherwise have been due on any circumvented booking.

11.Disputes Between Users

Any dispute arising from a booking is primarily between the Photographer and the Host. StudioRack may, at its discretion, assist in resolving disputes and may withhold a payout while a dispute is investigated, but is under no obligation to resolve disputes and accepts no liability for the outcome.

12.Liability

To the fullest extent permitted by law, StudioRack is not liable for any loss or damage arising from your use of a studio, the conduct of any user, the accuracy of any listing, or any interruption to the Platform. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law. Our total liability to you for any claim is limited to the amount of the StudioRack service fee paid on the relevant booking.

13.Content & Photos

By uploading photos or content to the Platform, you grant StudioRack a non-exclusive, royalty-free licence to use, display, and promote that content in connection with operating and marketing the Platform. You confirm you own or have the rights to any content you upload.

14.Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via the Platform or email. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

15.Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
